Please read this information carefully. By accessing or browsing the Total Materia website, platform, and/or by using any Total Materia products, you agree to these Terms of Use and the associated liability disclaimers.
The usage of all accounts is monitored and as such Total Materia AG reserves the right to cancel, close, or modify any account without notice period to any end-user who violates the terms of use, intellectual property, and fair usage policy, without refund.
Total Materia AG reserves the right to change its terms and conditions at any time without prior notice.
If you do not accept the Terms of Use stated here, please do not use any Total Materia reference data.
Any disputes arising from the interpretation of the Terms of Use shall fall within the jurisdiction of courts in Zurich, Switzerland.
Intellectual property and fair usage policy
The materials, information, and other content contained within the Total Materia website, platform, and/or standalone products are proprietary to and owned by Total Materia AG.
The purpose of the fair usage policy is to ensure Total Materia is used for its intended use as an informational resource and protects the ownership of the data contained within and the potential of mass replication of the Total Materia data.
The maximum quantity of viewed pages should not exceed 2000 pages per month per license or a proportional quantity for a shorter period. For instances where such needs are defined, Total Materia will assist in providing an alternative solution to the user.
Gathering data from the Website through manual harvesting or automated means, including but not limited to the systematic manual saving of data, and use of scripts, bots, or web crawlers, is strictly prohibited.
Total Materia contains some SAE International information, which has been and is licensed with permission for use by Total Materia AG, in Total Materia only. No further sharing, duplicating, or transmitting is permitted. The true authority of any SAE standard is the PDF version, which can be found at saemobilus.sae.org.
Transferability and cancellation policy
This license is not transferable to third person without written approval from Total Materia AG.
Cancellation of license by user is not possible.
Registered single user web edition
Single User Web Edition license of Total Materia is a named license registered for use on a single computer. In addition, limited remote access can be granted to the person named on the license using an automatic one-time password, provided that it does not exceed 30 (thirty) sessions per year.
The Single User Web Edition license cannot be transferred to a different named user without the written approval of Total Materia AG.
Registered multiuser web edition
According to the selected license description, the account is restricted by the allowable locations for the specific license type and the number of named users as agreed at the point of purchase. Any usage outside these restrictions must be approved by written and signed confirmation from Total Materia AG.
Multiuser Network Editions of Total Materia are for use by the acquiring company only and are not permitted for use by any third party without the prior written approval of Total Materia AG.
Disclaimer of Warranty
THE TOTAL MATERIA DATABASE IS PROVIDED “AS-IS” AND WITH ALL FAULTS. NEITHER TOTAL MATERIA AG NOR ANY PERSON ON TOTAL MATERIA AG’S BEHALF HAS MADE OR MAKES ANY EXPRESS OR IMPLIED REPRESENTATION OR WARRANTY WHATSOEVER WITH RESPECT TO THE TOTAL MATERIA WEB SITE, SOFTWARE, DATABASE OR ACCOMPANYING INFORMATION, INCLUDING ANY WARRANTY OF: (i) MERCHANTABILITY; (ii) FITNESS FOR A PARTICULAR PURPOSE; (iii) TITLE; (iv) NON-INFRINGEMENT; (v) DATA ACCURACY; OR (vi) PERFORMANCE TO SPECIFIC STANDARDS, WHETHER ARISING BY LAW, COURSE OF DEALING, COURSE OF PERFORMANCE, USAGE OF TRADE OR OTHERWISE, ALL OF WHICH ARE EXPRESSLY DISCLAIMED, AND YOU ACKNOWLEDGE THAT YOU HAVE NOT RELIED ON ANY REPRESENTATION OR WARRANTY MADE BY TOTAL MATERIA AG, OR ANY OTHER PERSON ON TOTAL MATERIA AG’S BEHALF.
Database Limitations
YOU HEREBY ACKNOWLEDGE AND AGREE THAT THE INFORMATION CONTAINED IN THE TOTAL MATERIA DATABASE IS INTENDED TO SUPPLEMENT, NOT REPLACE, THE KNOWLEDGE, SKILL, AND JUDGMENT OF ENGINEERING PROFESSIONALS REGARDING MATERIALS, THEIR PROPERTIES, AND SUITABILITY FOR A PARTICULAR APPLICATION.
THE DATA IS AVAILABLE FOR QUALIFIED PROFESSIONALS TO FIND RELEVANT INFORMATION AND SAVE TIME AND EFFORT AS THEY INVESTIGATE THE ANTICIPATED BEHAVIOR OF SPECIFIC MATERIALS. MATERIAL PROPERTIES MAY VARY SIGNIFICANTLY AND CAN DEPEND ON THE SUPPLIER AND SUPPLIER'S INTERNAL STANDARDS, HEAT TREATMENT, DIMENSIONS AND OTHER PARAMETERS. YOU AGREE THAT IN NO EVENT SHALL TOTAL MATERIA AG BE LIABLE FOR ANY DAMAGES OF ANY KIND, INCLUDING WITHOUT LIMITATION ANY DIRECT, SPECIAL, INCIDENTAL, INDIRECT, OR CONSEQUENTIAL DAMAGES WHATSOEVER (INCLUDING, BUT NOT LIMITED TO, DAMAGES FOR: LOSS OF PROFITS, LOSS OF INFORMATION OR BUSINESS INTERRUPTION, NEGLIGENCE, AND ANY OTHER PECUNIARY OR OTHER LOSS ) ARISING OUT OF OR RELATED TO THE USE OF OR INABILITY TO USE THE DATABASE OR MATERIALS INFORMATION, EVEN IF TOTAL MATERIA AG KNOWS OF, OR SHOULD HAVE KNOWN OF, THE POSSIBILITY OF SUCH DAMAGES. IF YOU ARE DISSATISFIED WITH ANY PORTION OF THE DATABASE, YOUR SOLE AND EXCLUSIVE REMEDY IS TO DISCONTINUE USING THE DATABASE. THE FOREGOING LIMITATIONS, EXCLUSIONS AND DISCLAIMERS SHALL APPLY TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, EVEN IF ANY REMEDY FAILS ITS ESSENTIAL PURPOSE.
